Is R.A.8190 should prevail in hiring teacher 1 applicant?
Gud pm,
Teacher I applicant po ako, rank 21 of 45 total (district) applicants but rank 1 of the 3 bona fide applicant in our barrio. Nabasa ko po sa DO #20 s.2009, (existing criteria for hiring teacher I)" matching of qualified applicants consistent with the provisions of R.A. 8190 (Localization Law),provided, that the applicant meets the minimum qualification, and I learned that 1 of the teachers applying for transfer was granted and actually she has her own new item and her former item or position here will be filled up by the new teacher but I heard some hearsay na ang nasa proposal ng Supervisor ay ang rank 1 sa rqa na hindi taga-rito (pulo), taga-nayon at kasalukuyang naghihintay nalang ng appointment galing sa Division Office. Nang nabalitaan ko yon masyado akong nalungkot kc pagkakataon ko na sana lalo na't 35 y.o. na ako at baka next recruitment hindi na ako rank1 among bona fide applicants kc 1.48 points lang ang lamang ko ng sumunod sa akin na bona fide, I got 62.95pts., the cut-off score to qualify is 50pts., and besides, baka madagdagan pa kami ng mas nakakalamang pa sa amin next recruitment kc malapit na lumabas ang result ng LET Sept.2011. Narinig ko sa ilang School Heads na sinabi ,"anong silbi raw ng ranking kung hindi ipapatupad,,kawawa daw ang nangunguna sa rqa. Pagsikapin daw namin next time mag-rank1 upang makapasok", at imposible namang mangyari kahit hindi kami rank1 but we have the capability to teach naman. Hindi nila binigyang halaga ang nasa criteria tungkol sa R.A. 8190. Dahil dito, pupuntahan ko bukas ang Supervisor at tanungin kung totoo lahat na nabalitaan ko at kung totoo man ipapabatid ko sa kanya na hindi ako masaya at may gagawin akong hakbang para ipaglaban ang karapatang kinuha niya sa akin. Pupuntahan ko ang Division Office at hihingi ako ng clear written explaination signed by the School Division Superintendent tungkol sa R.A. 8190 at ibibigay ko sa District Supervisor upang lubusang maintindihan niya, kc sa existing teacher for transfer lang daw nila pinapatupad ang R.A. 8190, hindi raw sa new teacher.

Ito ang mga katanungan ko:
1. Meron bang discretionary power ang Supervisor na labagin ang alin sa mga nakasaad sa criteria (DO #20 s.2009)? Di ba batas yon at hindi pwede balewalain lalo na ang R.A. 8190?
2. Narinig ko sa ilang mga principals na babaguhin daw ang hiring guidelines at tatanggalin ang R.A. 8190, totoo ba ito?
3. Kalimitang School head na nagsasabi na binago o babaguhin ang criteria (pagtanggal ng R.A. 8190) yong mga may anak na nag-aaral pa lamang ng Education, masasabi kong personal na interes ang pina-iiral nila, sang-ayon ka ba sa nasa isip ko?
4. Halimbawa, kung nai-propose na ang rank1 sa rqa, pwede bang mapunta sa akin ang appointment sa bisa ng R.A. 8190 kahit hindi ako ang ini-recommend ng Supervisor?
5. Halimbawa kung handa na ang appointment sa rank1, balak kong mag-file ng protest,,hindi kaya ako iba-blacklist sa district?
6. Para sa inyo, tama ba itong lahat na gagawin ko na ipaglaban ang karapatan ko ngayon baka pag pinalagpas ko next recruitment hindi na ako ang rank 1 sa bona fide at mawawalan na talaga akong pag-asa makapasok?

Sana masagutan nyo ako agad upang malaman ko kung tama itong gagawin ko.

Please register to see links., otherwise known as the Localization Law, requires that "In the appointment or assignment of teachers to public elementary or secondary schools, priority shall be given to bona fide residents of the barangay, municipality, city or province where the school is located" (Sec. 1). In fact, the Dagupan City Schools Division Please register to see links. as one of the requirements for hiring new teachers that the teacher must be "a bona fide resident of the Barangay, Municipal/City, Province where the school is located and where the vacant item is available." (However, that should not be the case, since the requirement of the law should be understood as discretionary in the sense that if no one among the applicants is a bona fide resident, then the ranking must be followed, and the division office is not stopped from appointing.)

In fact, just this year, DepEd Please register to see links. all field offices to accomplish a survey form as to the implementation of the Localization Law.

Here are my answers to your questions. Note that this is what I understand of the regulations; I work in a private school.

1. Not even the DepEd Secretary himself has the power to disregard the requirements of RA 8190. How much more a district supervisor or a principal? It is a law that must be followed by all, no matter how we think the law is unjust. As we say in law school, dura lex, sed lex. The law may be harsh, but that is the law.

2. We should wait for Congress to change the law. (Hint: It's not soon.)

3. You may think that way or otherwise, but it won't help your case. You must assume good faith. Perhaps the supervisor is genuinely concerned about the perceived unfairness of that law.

4. Yes, if I understand correctly, the appointing authority is really the DepEd Secretary delegated to the Division Superintendent; they are usually more knowledgeable of the law, and they have more to loss by violating it.

5. Why would you be blacklisted? And why should you be afraid to be blacklisted? Just be polite with your approach, and if they don't want to follow the law, then so be it.

6. Yes. Fighting for what is legally granted to us is not dishonorable.

Some more points:

1. Note that you must file your protest within three months from appointment. Else, your protest will not be entertained anymore.

2. Take a look at this Please register to see links. - I'm not sure if there is a more current version of this, but this is the one in my notes. Take note of paragraph 4: "Anyone found violating the provisions of the revised hiring guidelines embodied in this Order shall be dealt with accordingly."

Section 2 of RA 8190: "Sec. 2. In the exercise of its disciplinary authority, the Secretary of Education, Culture and Sports shall impose the following administrative sanctions for any willful violation of this Act: (1) first violation — suspension of one (1) month without pay; (2) second violation — suspension of two (2) months without pay; and (3) third violation and subsequent violations hereof — suspension of six (6) months without pay."

3. Take note of Section 9 of the guidelines themselves: this deals with the rules on selection.

May similarity din po iyan sa problema namin dito sa Catanduanes.
gusto ko lng po tulungan yung kaibigan kong Rank 1,
almost one year n po syang nag-aantay ng appointment pero naunahan pa po sya ng Rank 2 and the rest, halos lahat po sila permanent na, Because of KAKILALA/KAMAG-ANAK SYSTEM here in Catanduanes lahat na karapatdapat na mga teachers ay hindi nakakapasok. Majority sakanila ay sa Manila na nag-aapply.
Isa pa po dahil din po sa KAKILALA/KAMAG-ANAK SYSTEM, yung mga bagong Teachers na mahina sa sistema at walang kapit ay minamaliit ng mga malalakas na teachers, pinagtutulungan po at hindi binibigyan ng chance mag-paliwanag at ipagtanggol ang sarili. At the same time mas kinakampihan ng mga heads ang mga malalakas na teachers... (Play-safe)
Meron po bang Laws para dito?
May laban po ba ang mga teachers na walang kamag-anak sa sistema?

yung iba ko po kasing kasamahan,
nagpost lang ng quotes,sayings, and verses sa ibang site, pinatawag po agad sa office at may warning na po sila na maari silang ma-blacklist, at di na makapag-apply sa ibang school.

@xirneq: They'll have to file a case in court against me before I'll even divulge the email address you used to register here Big Grin (And no, filing the case won't make me divulge the information - I'll only give it once and if the court orders me to do so.)

I suggest you bring this up to some media people, like GMA7's Imbestigador. The media men will know you of course, but they won't tell DepEd who you are. They'll just set up ways to catch the culprits.

But as for me, do not be afraid to divulge, expose or refer this problem to anybody or even to the concern individuals in a just manner so that those concerns individuals will be awakened in their illicit acts.

may concern po ako regarding sa localization law.

pwede po bang ma consider na bona fide resident na ang isang new applicant for teacher I sa isang lugar kahit hindi siya nakatira doon? nakikitara lang po siya sa bahay ng boyfriend niya. nagmula siya sa neighboring province.


pwede rin bang ma propse ang isang new applicant for teacher I kahit dinhi siya kumuha ng English Proficiency Test? hindi po ba priority ang new applicant na graduate ng DEED kaysa sa BSED kung ang vacancy ay nasa elemtary school?

I do hope na masasagot ninyo at mabibigyang linaw ang mga katanungan ko.

Sad to think that we have this BIAS SYSTEM in the Philippines. Ganun din po nangyari sa akin. I was so happy pa naman when they told me I was the RANK 1 in DISTRICT RANKING and RANK 4 in DIVISION RANKING LAST SCHOOL YEAR 2011-2012. But here I am now, still a substitute TEACHER. Mas nauna pa yung RANK 5 na magkaITEM even if she's just a fresh Graduate with 9 months experience, while ako I have been teaching for 2 years in a PRIVATE SCHOOL. *sigh*

Gusto ko man pong magREKLAMO kasi super unfair po talaga.. pero natatakot ako kasi DIVISION SUPERVISOR po yung AUNT niya.

I am still HOPING pa naman ko na ma-IN ako.. pero sana wala ng DAYAAN..
