Question on transfer
I am a teacher of Compostela Central Elementary School which is located in the same barangay where I live. I've been teaching here since I got my appointment as teacher 1-regular(since August 2008). I've just been informed by my school principal that she's decided to transfer me to Baclog Elem. School. It's a newly built school located in another barangay. It's like more than 4 klms away from where I live. It's a lot smaller than the central school.

In connection to this, I would just like to ask if I have the right to refuse to be transfered because of the following grounds:

1. Sec. 6 of RA 4670 . Consent for Transfer Transportation Expenses. Except for cause and as herein otherwise provided, no teacher shall be transferred without his consent from one station to another.

Where the exigencies of the service require the transfer of a teacher from one station to another, such transfer may be effected by the school superintendent who shall previously notify the teacher concerned of the transfer and the reason or reasons therefor. If the teacher believes there is no justification for the transfer, he may appeal his case to the Director of Public Schools or the Director of Vocational Education, as the case may be. Pending his appeal and the decision thereon, his transfer shall be held in abeyance: Provided, however, That no transfers whatever shall be made three months before any local or national election.


2. My superior hasn't given me enough/valid(as far as I could asses)reason why I should be transferred when the central school where i used to teach is expanding and is lacking teachers. Apparently, she hasn't given me any reason as yet. Binigla nya ako kasi wala man lng kanotice notice.

2. There are teachers who have just been appointed teacher 1 who could be assigned there.

3. I believe the reason why she wants me out of her supervised school is that because she has a personal dislike towards me. It started when I refused to accept her "pautang".

4. I know I've been an asset to the central school because aside from graduating in college with flying colors and topping the teacher-applicants ranking back in 2008, I've been hosting the school events specially those big ones. And to be fair to me, the school has made use of my being in a radio station for more than 7 years. In fact, last Brigada Eskwela, we won third place in the region. And I did the school's audio-visual presentation.

5. Isn't it demeaning/degrading to know that you have been working in a central school and suddenly you will be transferred to a lot smaller school? I mean, it would've been okay for me if it was for the sake of promotion or if i feel there was indeed a need to transfer me but no.

6. Di nga ba't may nag aaply maitransfer sa kanilang hometown dahil mas maigi at mas madali para sa kanila ang magturo kung saang lugar sila talagang napapabilang?

Hi Judy,

It seems that you are on the right here. Forward your appeal to the district supervisor and higher authorities. Then inform us of the progress of your case.
